Order 19/03/2026
1. The instant criminal misc. petition has been preferred by the petitioner with the following prayer:
“a. by an appropriate Writ, Order or Direction, the Court of the Learned Metropolitan Magistrate, No.11, Jaipur Metropolitan-II, Jaipur may kindly be directed to expeditiously dispose off the subject Criminal Case
[2026:RJ-JP:11823] (3 of 4) [CRLMP-7173/2021] No.113/2003 pending before it preferably within a period of three months or within such other fixed time period as may be deemed to be fit and proper by the Hon’ble High Court; b. by an appropriate Writ, Order or Direction, the Court of the Learned Metropolitan Magistrate, No.11, Jaipur Metropolitan-II, Jaipur may also kindly be directed to ensure a strict compliance by the respondent No.2 to either itself or through its counsel directly participate in the subject proceedings and merely assist the learned Assistant Public Prosecutor that too, only through the counsel of the respondent No.2. Alternatively, to quash the impugned order dated 25.07.2003 to the extent to which thereby the respondent No.2 was accorded permission to participate through his counsel; and c. any other order(s), relief(s) or direction(s), which the Hon’ble High Court may deem to be fit & proper may also kindly be passed in favour of the humble petitioner- applicant.”
2. By way of filing the instant criminal misc. petition, a prayer has been sought for issuing directions to the court of the Metropolitan Magistrate No.11, Jaipur Metropolitan-II for expeditious disposal of the Criminal Case No. 113/2003 in stipulated time.
3.
Learned counsel for the petitioner submits that a complaint under Sections 420, 406 and 120B IPC has been submitted by the petitioner and the same is still lying pending for adjudication before the Court below since last more than 23 years and still the complaint is at the stage of framing of charges, so under these circumstances, appropriate directions be issued to the Court below to proceed with the matter expeditiously and decide the complaint within a period of three months.
4. Heard and considered the submissions made at the Bar and perused the material available on the record.
[2026:RJ-JP:11823] (4 of 4) [CRLMP-7173/2021]
5. Perusal of the record indicates that the complaint submitted by the petitioner before the Trial Court in the year 2003 is still lying pending for adjudication. More than 23 years have been passed thereafter and till date charges have not been framed.
6. It is quite shocking and surprising on the part of the Trial Court that no orders have been passed even at the stage of framing of charges/discharge.
7. The Hon’ble Apex Court in the case of High Court Bar Association, Allahabad vs. State of Uttar Pradesh & Ors., while deciding the Criminal Appeal No.3589/2023 on 29.02.2024 has deprecated the practice of the Courts of issuing directions to the subordinate Courts to decide the matter in a timeline.
8. Considering the above proposition of law as propounded by the Hon’ble Apex Court in the case of High Court Bar Association, Allahabad (supra), this Court cannot fix any specific time limit to decide the matter. However, in view of the fact that the matter has been pending since 2003, it is expected from the Trial Court to make all possible endeavours to proceed with the matter and conclude the proceedings expeditiously, as early as possible, without entertaining any unnecessary request made by either side to defer/adjourn the matter.
9. Accordingly, the criminal misc. petition stands disposed of. All pending applications, if any, also stand disposed of.
