2026:MHC:2889 WP Crl. No. 1450 of 2026 __________ Page2 of 5 grant 28 days emergency leave without escort to the petitioner’s Son Raja @ Rajasekar S/o. Anthony Dass, aged 45 years (PID 87028), confined at Central Prison I, Puzhal, Chennai. For Petitioner(s): MR.N.Nagarjuna For Respondent(s): Mr.C.R. Malarvannan, Counsel for Government of Tamil Nadu (Crl. Side) ORDER (Order of the Court was made by Dr.Anita Sumanth J.) Challenge in this writ petition is the order dated 18.05.2026, rejecting the application for grant of leave of 28 days on emergency basis without escort to the petitioner’s son Raja @ Rajasekar, who is a convict lodged in Central Prison-I, Puzhal, Chennai. 2. We have heard Mr.N.Nagarjuna, learned counsel for petitioner and Mr.C.R.Malarvannan, learned Counsel for Government of Tamil Nadu (Crl. Side) for respondents. 3.At the outset, there is no provision for grant of emergency leave for 28 days and the representation could well have been rejected on that ground. Be that as it may, the authorities have gone into the reasons cited for grant of emergency leave, finding that both the reasons are incorrect. The convict had sought leave on the basis that he was required to attend to the repairs of his https://www.mhc.tn.gov.in/judis

Being factual, and since the petitioner admittedly does not have any other material to place in support of the reasons set out in the application, we see no reason to intervene and hence confirm the impugned order and dismiss this petition. 4.Needless to state that the petitioner and convict are always at liberty to approach the authorities setting out proper reasons seeking leave in line with the stipulations under the Tamil Nadu Suspension of Sentence Rules, 1982. Miscellaneous Petition (Crl.) is closed. (A.S.M.,J.) (S.M.,J.) 14-07-2026 Index: Yes/No Speaking Neutral Citation: Yes DP https://www.mhc.tn.gov.in/judis
