KAMAL ORAL ORDER Petitioner who is accused No.7 in Crime No.51/2026 registered for the offences punishable under Sections 54, 118(2), 119(1), 127(2), 140(1), 351(2), 352 R/W 3(5) OF BNS 2023 is before this Court seeking regular bail. 2. A complaint dated 11.02.2026 came to be filed alleging that the complainant was conducting fashion show and carrying on advertisement business. Accused Nos.1 and 2 who were in the business of production of movie had joined the complainant in his business. Accused No.2 had invested 5 to 6 lakhs and had some ill will against the complainant. Complainant had lent Rs.2,50,000/- to the accused No.1. Dispute arose between them resulting in complainant - 3 - HC-KAR NC: 2026:KHC:24483 CRL.P No. 6109 of 2026 registering a case in Tamil Nadu against the accused Nos.1 and 2. This had enraged the accused Nos.1 and 2. The complainant had come down to Bengaluru. Taking advantage of the situation, accused person conspiring with the other accused, kidnapped him on the pretext of purchasing his car and took him to an isolated place, assaulted him causing bleeding injuries, snatched his belongings such as mobile phone, gold ornament and ATM cards, threatening him of dire consequences if he informed the police or his family. Complainant was shifted to Sanjay Gandhi Hospital for treatment by the accused Nos.1 and 3. This incident was narrated by the complainant to the doctor resulting in the case being registered. 3. Learned counsel for the petitioner submits that accused Nos.3, 4, 5 and 11 have already been granted bail. There is no specific allegation against the accused No.7 either in the complaint or before the statement given to the doctor. His name has cropped up only while recording the alleged voluntary statement of accused Nos.1 and 2. Learned Additional SPP submits that as per the statement given before the police, serious allegations are made against the accused No.7/petitioner herein regarding his involvement in the crime. Hence seeks for rejection of the petition. 5. Heard and perused the records. 6. Perusal of the complaint indicate the allegations primarily made only against accused Nos.1 and 2 regarding certain financial dispute having arose between the complainant, accused Nos.1 and 2. It also indicates that the complaint having been filed by the complainant before the police in Tamil Nadu, which had apparently enraged accused Nos.1 and 2 to take revenge against the complainant, resulting in hatching of conspiracy allegedly involving the accused No.7/petitioner herein. Since there are no prime allegations against the accused No.7/petitioner either in the complaint or in the statement made and his name having been cropped only upon the alleged voluntary statement given by the accused Nos.1 and 2 and in the light of accused Nos.3, 4, 5, 11 having already - 5 - HC-KAR NC: 2026:KHC:24483 CRL.P No. 6109 of 2026 been granted bail, this Court deems it appropriate to allow the petition. Accordingly following: ORDER (i) Criminal Petition is allowed. (ii) The accused No.7/petitioner is directed to be enlarged on bail in Crime No.51/2026 registered by Adugodi Police Station for the offences punishable under Sections subject to the following conditions: a) The accused/petitioner shall execute personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh Only) with one surety for the likesum, to the satisfaction of the jurisdictional Court. b) The accused/petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons. c) The accused/petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses. - 6 - HC-KAR NC: 2026:KHC:24483 CRL.P No. 6109 of 2026 d) The accused/petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
