Side) ORDER The petitioner apprehends arrest for the alleged offence under Section 303(2) of the Bharatiya Nyaya Sanhita, 2023 read with Sections 21(1) and 21(4) of the Mines and Minerals (Development and Regulation) Act, 1957 in Crime No134 of 2026, on the file of the respondent police, seeks anticipatory bail. https://www.mhc.tn.gov.in/judis CRL OP No. 17467 of 2026 __________ Page2 of 4 2. The case of the prosecution is that the petitioner was involved in illegal transportation of 2 ½ units of river sand, in a tractor bearing Reg. No.KA-32- B-1760, without any valid permit or license. Hence, the case. 3. The learned counsel for the petitioner would submit that the petitioner is innocent and he has not committed any offence as alleged by the prosecution. He would further submit that the petitioner is ready to abide by any conditions that may be imposed by this Court and ready to co-operate with the investigation. Hence, he prayed to grant anticipatory bail to the petitioner. 4. Per contra, the learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and would submit that the petitioner has 2 previous cases of similar nature. 5. From the submissions made by the learned Government Advocate, it is seen that the petitioner has 2 previous cases of a similar nature. Therefore, as rightly contended by the learned Government Advocate, if the petitioner is enlarged on anticipatory bail, he would indulge in the commission of similar offences. Hence, considering such circumstances, this Court is not inclined to grant anticipatory bail to the petitioner. 6.
