Petitioner is before this Court seeking for the following reliefs: “(a) Issue writ of certiorari and quash the Annexure-M dated 23-06-2025 issued by the 2nd Respondent in No.LGP/Endorsement/2025- 26/30 and the Annexure-N dated 23-06-2025 issued by the 2nd Respondent in No.LGP/Endorsement/2025-26/31 and also Annexure-Q dated 24-10-2025 issued by the 2nd Respondent in No.LGP/Endorsement/ 55/2025-26. (b) Issue writ of mandamus directing the 2nd Respondent to provide water connection and issue NOC to the Petitioner's house to get the electricity connection. (c) Allow the writ petition with costs; - 3 - HC-KAR NC: 2026:KHC:393 WP No. 34430 of 2025 (d) Grant any relief/s as this Hon'ble Court deems fit in the circumstances of the case.” 2. The grievance of the petitioner is that electricity and water connection have not been issued to the construction put up by the petitioner, it is in that background that the petitioner is before this court seeking for the aforesaid reliefs to quash the Endorsement so issued. On enquiry with the learned counsel for the petitioner as to whether the petitioner has got a plan sanctioned for the construction, he fairly submits that there is no such plan which has been applied for by the petitioner. That the petitioner is ready to submit such a plan for approval if so permitted, within a period of two weeks from today. 3. A perusal of the photographs that has been produced along with the petition indicates that it is a farmhouse which has been constructed and there is enough and sufficient space for the petitioner to - 4 - HC-KAR NC: 2026:KHC:393 WP No. 34430 of 2025 comply with the applicable laws and ex-facie it appears that the petitioner has failed to obtain the plan sanction, which cannot be said to be deliberate at this stage. Considering that the petitioner is ready to submit the plan for sanction to respondent No.2, in that view of the matter, I pass the following: ORDER i. Writ petition is partly allowed. ii. The petitioner is permitted to submit a plan for sanction to respondent No.2 within a period of 15 days from today i.e., on or before 23.1.2026. iii. If such an application along with the plan are submitted by 23.1.2026, respondent No.2 is directed to consider the said plan and process in accordance with law and sanction the same within a period of - 5 - HC-KAR NC: 2026:KHC:393 WP No. 34430 of 2025 30 days from the date of receipt of the application. iv. Once such a plan sanction is issued, respondent No.2 is directed to issue necessary No Objection for the purpose of securing electricity and water connection to the property of the petitioner.
