2. This writ petition has been filed under Article 227 of the Constitution of India, whereby the petitioner has sought a direction to decide the interim injunction application 6C2 of the petitioner in Original Suit No.183 of 2025, Khalid Pundir vs. Shamoon and others, before the learned Civil Judge (J.D.), Roorkee, Haridwar within stipulated period.

From perusal of the record, it is reflected that the original suit has been filed by the petitioner-plaintiff only on 23.12.2025 and the notices were issued against the respondents-defendants on application for temporary injunction application no.6C2 under Order 39 Rules 1 and 2 of C.P.C. for objection and disposal and the case has been fixed on 13.01.2026.
4. It is also not clear that as to whether the respondents-defendants were served by today or not but prior to that present writ petition has been filed for seeking expeditious disposal of the 6C2 application.
5. This is preposterous, inasmuch as, that even before filing of the objection whether such a direction can be issued by this Court or not.
6. The writ petition is nothing but abuse of process of this Court by filing the same immediately after original suit and without awaiting for the service to be effected upon the respondents-defendants.
7. In such view of the matter, no good ground is made out at all to interfere in the present writ petition
under Article 227 of the Constitution of India to give any kind of relief to the petitioner-plaintiff.
8. Accordingly writ petition stands dismissed.
