The learned counsel for the petitioner submitted that the property in S.F. No. 59/3C, measuring approximately 40 cents in Kannanur Village, Chetpet Taluk, Tiruvannamalai District, originally belonged to one Chinnapaiyan @ Awalthar, the grandfather of the first petitioner. By way of succession, the first petitioner’s father became the absolute owner of the property and subsequently executed a settlement deed in favour of the first petitioner’s mother. To develop the property, the first petitioner’s mother approached the third respondent to survey the land. Since her request was not considered, she filed W.P. No. 39192/2016. This Court disposed of the said writ petition with a direction to respondents 2 to 4 to consider her representations after affording a hearing to any third parties. In the meantime, the first petitioner’s mother passed away, leaving behind the first petitioner, her daughter-in-law (the second petitioner), and her grandchildren (petitioners 3 and 4) as her legal heirs. 3. Upon receiving the certified copy of the court order, the first petitioner, through counsel, submitted a letter dated 19.03.2021 to respondents 2 to 4, requesting them to survey the property as directed. The first petitioner also sought information under the RTI Act, which revealed that a patta had been issued to one Mr. Palani for the subject property. The respondent further stated that because the first petitioner’s mother was not in possession of the property, https://www.mhc.tn.gov.in/judis WP No. 26293 of 2026 __________ Page4 of 6 the authorities were unable to survey the land despite this Court's direction. Aggrieved by this inaction, the petitioners have approached this Court. 4. Mr.M.Guruprasad, learned Government’s Counsel, who accepts notice on behalf of the respondents 1, 2 and 4 would submit that the petitioner’s land will be surveyed and demarcated in pursuance of the order dated 05.02.2021 passed in W.P.No.39192 of 2016 along with necessary police aid, within a time frame to be fixed by this Court. 5. Heard the learned counsel for the petitioner as well as the learned Government’s Counsel appearing for the respondents. 6.Considering the submissions made by both parties and in view of the limited prayer sought for in this writ petition, this Court without expressing any opinion on the merits of the case, directs the respondents to conduct a survey and demarcate the subject properties, within a period of four (4) weeks from the date of receipt of a copy of this order, after issuing prior notice and affording an opportunity of personal hearing to the petitioner and other parties concerned, as directed by this Court in W.P.No.39192 of 2016, vide order dated 05.02.2021. https://www.mhc.tn.gov.in/judis WP No. 26293 of 2026 __________ Page5 of 6 7. This Writ Petition stands disposed of with the above directions. No costs. Consequently WMP.No.28718 of 2026 is ordered, subject to payment of separate Court Fee. 8.
