The said Writ Petition was filed challenging the proceedings of the Tahsildar, Kadaladi Taluk, Ramanathapuram District dated 06.08.2022 in Reference No.T.R.No. 2022/27/21/001081SD. The writ petition was instituted against the Tahsildar as the first respondent and the vendors, namely, Banumathi, Nagammal, Veeran and Raman, as the private respondents. The owners of the property, represented by the present petitioner under a purported Power of Attorney, questioned the validity of the patta proceedings. 2. It is stated that the said Writ Petition was disposed of at the stage of admission on 03.12.2025 after hearing the learned counsel for the petitioners therein and the learned Additional Government Pleader appearing for the Tahsildar. It is further submitted that, pursuant to the said order, the patta standing in the name of the fourth respondent herein (the second respondent in the earlier writ petition) has been cancelled. It is also submitted that the order dated 03.12.2025 was carried in appeal before the Hon'ble Division Bench and that the appeal came to be dismissed, thereby, confirming the order passed by the learned Single Judge. However, a copy of the judgment of the Hon'ble Division Bench has not been produced before this Court. 4. The materials available on record disclose that the fourth respondent had purchased the subject property from her vendors under a Sale Deed dated 08.08.2012, registered as Document No.1149 of 2012 on the file of the second respondent-Sub Registrar. It was on the strength of the said registered Sale Deed that the Tahsildar had issued patta in favour of the fourth respondent, which became the subject matter of challenge in W.P.(MD) No.28983 of 2025. 5. Merely because the patta has allegedly been cancelled, does not mean that the registered Sale Deed dated 08.08.2012 stands invalidated. Unless the said Sale Deed is declared null and void by a competent Civil Court, no occasion arises for the registering authority to consider initiating action under Section 83 of the Registration Act, 1908 against the fourth respondent or her vendors. _____________ Page No. 3 of 5 https://www.mhc.tn.gov.in/judis W.P.(MD) No.19445 of 2026 6. Accordingly, the present Writ Petition is dismissed. However, liberty is reserved to the petitioner to approach the respondents under Section 83 of the Registration Act, 1908, if and when the petitioner obtains a favourable judgment and decree from the competent Civil Court declaring the Sale Deed dated 08.08.2012, registered as Document No. 1149 of 2012 on the file of the second respondent, as null and void. In the event the respondents fail to take action in accordance with law thereafter, it is open to the petitioner to work out his remedies in the manner known to law. There shall be no order as to costs.
