C.R.P.(PD)(MD)No.1832 of 2026 O R D E R The Civil Revision Petition is filed challenging the order passed by the trial Court dismissing the application filed by the petitioner seeking to summon the Village Administrative Officer for the purpose of producing certain revenue records relating to suit survey numbers. 2. The petitioner herein filed a suit seeking declaration of title and permanent injunction. The petitioner claims right over the suit property under the Settlement deed executed by her mother Panandhi dated 03.03.1999. It was the further case of the petitioner that before execution of settlement, the suit properties stood in the name of her mother Panandhi in the revenue records. In order to substantiate the said plea, the petitioner wants to summon the Village Administrative Officer for the purpose of production of revenue documents pertaining to the suit survey numbers. The said application was dismissed by the trial Court. Aggrieved by the same, the petitioner has come before this Court. 3. The learned counsel appearing for the petitioner would submit the revenue document in the name of petitioner's mother are very much relevant to substantiate the claim made by the petitioner in the suit 2/5 https://www.mhc.tn.gov.in/judis
C.R.P.(PD)(MD)No.1832 of 2026 and therefore, the trial Court ought to have allowed the application filed by the petitioner. 4. If the petitioner wants to produce revenue documents pertains to suit survey numbers, it is always open to him to file an application before the concerned revenue officials seeking certified copy of the same and produce it before the Court. Otherwise, the petitioner can also follow the procedure under Rule 76 of Civil Rules of Practise and produce the certificate issued by the Court before the revenue officials seeking certified copies of the revenue documents.
Instead of following the said procedure, the petitioner is not entitled to summon the revenue officials for the purpose of production of revenue documents. The trial Court rightly dismissed the application. I don't find any error in the order. 5. Accordingly, the Civil Revision Petition stands dismissed. No costs. Consequently, the connected civil miscellaneous petition is closed. 14.07.2026 NCC : Yes / No Index : Yes / No 3/5 https://www.mhc.tn.gov.in/judis
