The applicants have preferred this anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of Anticipatory Bail, apprehending their arrest in connection with Crime No. 13/2026, registered at Police Station – Narayanpur, District – Jashpur (C.G.) for alleged commission of offence punishable under Section 190, 191, 296, 115(2), 109, 324, 331 and 351(3) of the BNS. 2. As per the prosecution story in brief, is that the complainant has lodged report to the concerned police station with intend that on date of incident i.e. 04.02.2026 at about 9.00 O'clock in the night applicants entered into complainant's house and they have damaged the construction house and thereafter, the accused persons have RAJSHEKHAR SONI Digitally signed by RAJSHEKHAR SONI 2 committed marpeet with the complainant and his family member by lathi, danda and iron rod by using filthy language, due to this injured persons were received simple injuries. Based upon the such report, the concerned police station has registered offence. Hence, this application. 3. The learned counsel for the applicants has argued that the applicants are completely innocent and further submitted that the applicants are said to have assaulted the injured, and the injuries sustained to the injured are simple in nature. Hence, he prays for grant of anticipatory bail to the applicants. 4. On the other hand, learned State counsel opposed the prayer for grant of anticipatory bail and submitted that, it transpires that the applicants are said to have assaulted the injured with Lathi, Danda and Iron Rod by using filthy language, and the though the injured has sustained simple injuries on his person, but the anticipatory bail application of the co-accused person has also been rejected by this Court vide order dated 18.03.2026 passed in MCRCA No.407/2026. Therefore, the present anticipatory bail application of the applicants is liable to be rejected. 5. I have heard learned counsel for the parties and perused the material available on record. 6. Considering the facts & circumstances of the case, allegations levelled against the applicant in the FIR, and from the perusal of the records available, it transpires that the applicants are said to have assaulted the injured with Lathi, Danda and Iron Rod by using filthy language, 3 and the though the injured has sustained simple injuries on his person, but the anticipatory bail application of the co-accused person has also been rejected by this Court vide order dated 18.03.2026 passed in MCRCA No.407/2026, thus, I am not inclined to grant anticipatory bail to the applicants. 7. Accordingly, the Anticipatory Bail application of the applicants – Suresh Kumar Yadav and Naimish Yadav, filed under Section 482 of the BNSS, 2023 in connection with Crime No. 13/2026, registered at Police Station – Narayanpur, District – Jashpur (C.G.) for alleged commission of offence punishable under Section 190, 191, 296, 115(2), 109, 324, 331 and 351(3) of the BNS, is rejected.
