JUSTICE PARTHIVJYOTI SAIKIA ORDER 17.03.2026 Heard Mr. B M Choudhury, learned counsel appearing for the petitioner. Also heard Mr. D P Goswami, learned Additional Public Prosecutor, Assam. By this application filed under Section 483 of the BNSS, 2023 the petitioner, namely, Sri Debajit Gogoi @ Jugo, has prayed for release on bail in connection with P.R. Case No. 146/2026 arising out of Pulibor P.S. Case No. 06/2026 pending in the Court of the learned Chief Judicial Magistrate, Jorhat. On 30.01.2026, the informant received a phone call from his friend who claimed that he and his associates Page No.# 2/2 were attacking by some persons. The informant immediately went there to save his friend and his associates. When the informant reached the spot, he found that his friend and some other persons were present there. Then the unknown persons had attacked the vehicle of the friend of the informant and, thereafter, the persons attacked the informant with sharp weapons. Medical Report shows that the informant sustained simple injuries. In this case, Police has filed charge sheet and the trial is also going on. Considering entire aspect of the matter, this Court is of the opinion that under the given circumstances, there is no necessity for keeping the petitioner in custody. In view of the above, the petitioner, namely, Sri Debajit Gogoi @ Jugo, is allowed to go on bail in connection with P.R. Case No. 146/2026 arising out of Pulibor P.S. Case No. 06/2026 pending in the Court of the learned Chief Judicial Magistrate, Jorhat by executing a bail bond of Rs.25,000/- with one surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Jorhat. The petitioner is directed to appear before the learned Trial Court on each and every date of hearing as fixed by the Trial Court failing which the learned Trial Court shall have the liberty to take steps for procuring the attendance of the petitioner.
