Mr. Piyush Sammal, learned counsel through VC assisted by Ms. Sarita Bisht, learned counsel for the Applicant. 2. Mr. Pradeep Lohani, learned AGA, for the State of Uttarakhand. 3. In the High Court of Uttarakhand, the present case arises from Bail Application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking regular bail for the Applicant – Manjeet Singh, who has been accused in FIR No.03 of 2026, dated 06.01.2026, under Sections 8/21/60 of the Narcotic Drugs and Psychotropic Substances Act, 1985, at Police Station Kathgodam, District Nainital. 4. The case of the prosecution is that on 06.01.2026, the Police Party headed by SI, while on patrolling and checking duty near Gaulapul area, allegedly received the information from the informant that a person was coming from Chorgalia side on a motorcycle carrying smack. Acting upon the information, the Police allegedly apprehended the present Applicant and recovered 275 grams of smack from the pocket of his jacket, thereafter memo was prepared on the spot and consequently an FIR was lodged. 5. Learned counsel representing the Applicant submits for the consideration of the bail that Applicant is innocent and has been falsely implicated in the present case and the recovery is
false and fabricated. He further submits that the mandatory provisions of the NDPS Act, including Sections 42, 43 and 50 have not been strictly complied with. He further submits that the Applicant is languishing in jail since 07.01.2026 and the Applicant has no previous criminal history. 6. The bail application of the Applicant has been vehemently opposed by the learned State Counsel on the ground that the Applicant has previous criminal history. 7. Considering the overall facts and circumstances of the case, the Applicant has made out a case for bail. 8. Accordingly, bail application is allowed.
It is directed that the Applicant - Manjeet Singh, who has been accused in FIR No.03 of 2026, dated 06.01.2026, under Sections 8/21/60 of the Narcotic Drugs and Psychotropic Substances Act, 1985, at Police Station Kathgodam, District Nainital, be released on bail on furnishing a personal bond with two reliable sureties each in the like amount to the satisfaction of the concerned court. The Applicant shall cooperate with the trial proceedings and shall not misuse the liberty granted to him. ( Ash ish Nait h an i, J.)
