SPP FOR R1) THIS CRL.P IS FILED U/S 482 CR.P.C (U/S 528 BNSS) PRAYING TO QUASH THE PROCEEDINGS IN C.C.NO.11123/2020 ARISING OUT OF CR.NO.20/2020 REGISTERED BY THE FIRST RESPONDENT AMRUTHAHALLY POLICE, PENDING ON THE FILE OF XLI ACJM, BENGALURU, FOR THE OFFENCES P/U/S 419, 420, 423, 424, 465, 471, 482, 483, 109 R/W 34 OF IPC AND IMPUGNED AT ANNEXURE-A. THIS PETITION, COMING ON FOR ADMISSION, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner is before this Court calling in question the proceedings in C.C.No.11123/2020 registered for the offences punishable under Sections 419, 420, 423, 424, 465, 471, 482, 483, 109 read with Section 34 of Indian Penal Code. 2. Heard Sri.Vijaykumar Prakash, learned counsel appearing for the petitioner, Sri.B.N.Jagadeesha, learned Addl. SPP appearing for the respondent No.1-State and have perused the material on record. - 3 - HC-KAR NC: 2026:KHC:2462 CRL.P No. 15113 of 2025 3. A perusal at the summary of the charge sheet would indicate allegations only against accused Nos.1 and 2 and nothing against accused No.3. In the ordinary course, the trial should have been stayed against the petitioner, but the charges are framed three years ago and the trial is in progress. In that light, the petition under Section 482 of Cr.P.C. would not in the normal circumstance become entertainable. Therefore, I deem it appropriate to dispose the petition with a direction to the concerned Court to exempt the appearance of the petitioner-accused No.3 throughout the trial unless specifically necessary or warranted. 4. With the aforesaid observation, the petition stands disposed. Sd/- (M.NAGAPRASANNA) JUDGE CBC List No.: 1 Sl No.: 37 CT:SS
