This is another case where the high-handed approach of the Tahsildar and other revenue authorities is clearly depicted. The name of the petitioner is reflected in the RTCs at Annexures-H and J and despite the said - 3 - HC-KAR NC: 2026:KHC:5563 WP No. 33525 of 2025 admitted facts, the 3rd respondent-Tahsildar, Koratagere Taluk, is not conducting the phodi proceedings. On the other hand, the petitioner is called upon to furnish the original documents to prove the grant said to have been made in favour of the petitioner and petitioner’s father. 3. This Court in several cases has held that so long as the name of person is reflected in the RTC showing as khatedar in Column No.9, he/she is entitled to seek phodi and durasth of the said land. The question of verifying the original grant records at this stage would not arise. 4. Consequently, the writ petition stands disposed of with a specific directions to the 3rd respondent- Tahsildar, Koratagere Taluk and 4th respondent-Assistant Director of Land Records, Koratagere Taluk, to proceed to conduct phodi and durath of the land in question and complete the same as expeditiously as possible and at any rate within a period of 2 (Two) months from the date of receipt of a copy of this order. - 4 - HC-KAR NC: 2026:KHC:5563 WP No. 33525 of 2025 5.
