The short grievance of the petitioner is that the respondents are trying to interfere with the petitioner’s peaceful possession and enjoyment over the subject property admeasuring Ac.0.96 cents in Sy.No.464-A situated in Horsley Hills, Kotavaru village, Madanapalle mandal, Annamayya district by erecting board forcibly in the subject property. 2.
Heard Sri K.B.Ramanna Dora, learned counsel for the petitioner and Sri Venkata Satyanaryana, learned Assistant Government Pleader for Revenue Department. 3
3. Taking into consideration the facts and circumstances of the case, on 27.06.2023, this Court has granted interim orders which reads as follows:
“In the meanwhile, status quo with regard to the subject matter existing as on today shall be maintained by both sides in all respects and no coercive action in respect of the subject matter property shall be resorted to by the respondents.”
4. Though the matter is of the year 2023 and despite granting sufficient time, the respondents did not choose to file counter nor placed any instructions on record till date. In the said circumstances, instead of keeping the writ petition pending, by duly considering the interim order granted by this Court on 27.06.2023, this Court is inclined to dispose of the writ petition with the following direction:
“The respondent authorities are directed not to interfere with the subject property except under due process of law.”
