Petitioner is before this Court seeking for the following reasons. 1. Issue writ of mandamus or in the nature thereof or any other appropriate writ, directing the respondent No. 2 to issue modified final layout plan for the Sy No. 45/2 45/4 45/6 46/1 45/2 46/3 46/4 46/5, 46/6, 46/8 46/9, 46/10 46/11, 46/13 totally measuring about 30 acres 24.12 guntas at Chikkahalli village, Udigere Hobli, Tumkur Taluk & district in terms of resolution dated 04/10/2025 vide ANNEXURE-G in the interest of justice and equity. 2. Issue writ of mandamus or in the nature thereof or any other appropriate writ, directing the respondent No. 2 to pass an order for release of sites in terms of resolution dated 04.10.25 (Annexure-G) in the interest of justice and equity. - 3 - HC-KAR NC: 2026:KHC:1134 WP No. 33242 of 2025 3. To pass any such order as this Hon'ble court deems fit in the circumstances of the case in the interest of justice and Equity. 2. The grievance of the petitioner is that a modified final layout sanction plan as also an order of release of sites has not been granted by respondent No. 2, despite a resolution having been passed in terms of Annexure-G dated 04.10.2025. 3. Learned counsel for respondent No. 2 would submit that the said resolution contains certain conditions. Those conditions are yet to be satisfied by the petitioner. As and when the said condition/s is/are satisfied by the petitioner, respondent No. 2 will act in terms of the said resolution. 4. The further submission of learned counsel for respondent No.2 is that on the compliance being made by the petitioner, the respondent No.2 would issue the modified plan sanction as also the order - 4 - HC-KAR NC: 2026:KHC:1134 WP No. 33242 of 2025 of release of the sites within 6 weeks thereafter is placed on record. 5. The said submission of learned counsel for respondent No. 2 answers the grievance of the petitioner inasmuch as, it is for the petitioner to comply with all the requirements under the aforesaid resolution and furnish the document of compliance to respondent No. 2 for respondent No. 2 to act in terms of resolution. 6.
