Sl.7 10.02.2026 Court No.19 BP WPA 2031 of 2026 Rabiul Laskar -versus- The State of West Bengal and others Mr. Partha Pratim Roy Mr. Dyutiman Banerjee ..for the petitioner Mr. Rabindra Nath Pal Mr. Razzak Hossain ..for the State The petitioner alleged that in the record of rights the name of the petitioner has been deleted and in its place the name of the private respondent has been incorporated. The petitioner is aggrieved by the action of an authority under the West Bengal Land Reforms Act, 1955, which is a specified act under Section 2(r ) of the West Bengal Land Reforms and Tenancy Tribunal Act, 1997. In view of the alternative and efficacious remedy available under the 1997 Act, this Court is not inclined to entertain this instant writ petition. The learned advocate appearing for the petitioner places reliance upon an order dated 11th November, 2025 passed in a batch of writ petitions the lead case being WPA 25183 of 2025 in support of his contention that the writ petition can be entertained. In the order dated 11th November, 2025 no ratio has been decided and the same is only an interim order. What is binding upon the Court 2 is the ratio decided in a particular case and since no ratio has been decided in the order dated 11th November, 2025 the same cannot come to the aid of the petitioner in the case on hand. Faced with such situation the learned advocate appearing for the petitioner prays for leave to withdraw this writ petition with liberty to approach the West Bengal Land Reforms and Tenancy Tribunal. In the light of the submissions made by the learned advocate for the petitioner, WPA 2031 of 2026 stands dismissed as withdrawn with liberty to the petitioner to approach the appropriate forum in accordance with law on the self same cause of action.
