THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE R DEVDAS ORAL ORDER The grievance of the petitioner is that the 4th respondent-Tahsildar, Anekal Taluk has not acted upon the representation at Annexure-A dated 23.09.2024 given by - 3 - HC-KAR NC: 2026:KHC:2817 WP No. 33344 of 2025 the petitioner to enter his name in the revenue records and continue the same in the computerized RTC. 2. It is the contention of the petitioner that 3 Acres and 35 Guntas of land in Sy.No.6 of Chokkasandra Village, Anekal Taluk was granted in favour of Sri.Muniswamy, the grandfather of the petitioner in terms of order, bearing number DD-31/53-54 and the Grant Certificate was also issued in favour of Sri.Muniswamy on 24.12.1954, as found in Annexure-B. It is further contented that the revenue records were mutated in the name of Sri.Muniswamy and after his death, the khata was transferred in the name of the grantee's wife- Smt.Ramakka, by mutation order bearing MR No.07/1989- 90 and thereafter, the name of the petitioner was entered in the RTC in terms of mutation order bearing No.26/1995-96. However, after computerization the name of the petitioner has not been continued in the RTC. Therefore, the prayer in the writ petition is to issue a writ of mandamus directing the respondent-revenue authorities - 4 - HC-KAR NC: 2026:KHC:2817 WP No. 33344 of 2025 to enter the name of the petitioner and continue the same in the computerized RTC. 3. Learned High Court Government Pleader submits on instructions that an FIR has been registered against the Tahsildar, Anekal Taluk and other revenue officials for manipulation of the records including Survey No.6 of Chokkasandra Village. The FIR is registered as Crime No.379/2025 before the Anekal Police Station, pending on the file of the learned Principal Civil Judge & JMFC., Anekal. That being the position, learned High Court Government Pleader submits that it would be impermissible for the Tahsildar to consider the request made by the petitioner at this stage. 4. Having regard to the submissions made by the learned High Court Government Pleader and the fact that an FIR has been registered against the Tahsildar, the writ petition stands disposed of reserving liberty to the petitioner to await the outcome of the investigation and the crime registered against the Tahsildar. Depending on - 5 - HC-KAR NC: 2026:KHC:2817 WP No. 33344 of 2025 the outcome of the criminal case, if it is found that the grant made in favour of the petitioner's grandfather is genuine, then the petitioner is at liberty to move the revenue authorities to have his name entered in the revenue records.
