JUSTICE SHIVASHANKAR AMARANNAVAR ORAL ORDER 1. This petition is filed by accused No. 1 under Section 483 of the BNSS praying to grant bail in S.C. No. 169/2024 pending on the file of I Additional District and Sessions Judge, Kolar registered for offence under Sections 120(B), 364, 364(A), 384, 307, 324, 341, 342, 395, 342, 201 of IPC. 2. Heard learned counsel for petitioner and learned HCGP for respondent - State. 3. Petitioner - accused No. 1 is facing trial for aforesaid offences in S.C. No. 169/2024. Petitioner had been granted bail by order dated 09.04.2021 passed in Crl. Misc. No. 213/2021 with conditions. Thereafter, the petitioner executed bond for a sum of Rs.1,00,000/-, - 3 - HC-KAR NC: 2026:KHC:483 CRL.P No. 15193 of 2025 furnished sureties and he was released on bail. Subsequently petitioner remained absent. The trial Court issued NBW against petitioner. Petitioner has been secured by executing NBW on 01.08.2025. Since then petitioner is in judicial custody. 4. Petitioner, now has deposited Rs.1,00,000/- towards forfeited bond amount before the trial Court on 29.12.2025. Said amount deposited by the petitioner requires to be appropriated to the State towards forfeited bond amount. Petitioner had not appeared before the trial Court as there was communication gap between petitioner and his counsel. Petitioner has now undertaken to appear before the trial Court on all dates of hearing and co- operate for speedy trial. Considering the above aspects, petitioner has made out case for grant of bail with conditions. 5. No. 169/2024 pending on the file of I Additional District and Sessions Judge, Kolar Subject to following conditions: I. Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with one surety for the likesum to the satisfaction of the trial Court. II. Petitioner shall not tamper the prosecution witnesses either directly or indirectly. III. Petitioner shall attend the trial Court on all dates of hearing unless exempted and cooperate for speedy disposal of the case.
