p. 1 IN THE HIGH COURT OF ORISSA AT CUTTACK ABLAPL No.1508 of 2026 Pratap Das & another …. Petitioners Ms. U. Pati, Advocate -Versus- State of Odisha …. Opposite Party Mr. S. K. Lenka, ASC CORAM: MR. JUSTICE R.K. PATTANAIK Order No. ORDER 17.03.2026 01. 1. Heard learned counsel for the petitioners and State. 2. Instant petition has been filed under Section 482 BNSS by the petitioners seeking pre-arrest bail in connection with Gopalpur P.S. Case No.0006 of 2026 corresponding to C.T. Case No.26 of 2026 pending in the court of learned J.M.F.C. (R), Balasore on the grounds stated. 3. Perused the FIR as at Annexure-1. It is submitted to the Court that the petitioners are having no antecedent and first- time offenders and alleged to be involved on the basis of the confessional statements of the co-accused, who are on bail. Gone through the FIR and it reveals that there was burglary in the house of the informant with the removal of valuables. Recorded the objection of the State. Since the petitioners involvement is alleged with the disclosure made by the co- accused persons and claim to have no other antecedent, this p. 2 Court, though not inclined to grant them pre-arrest bail but is of the view that they should surrender before the learned court below for being released with the plea advanced for a decision on bail and in case of rejection to approach the Sessions Court during the second hour for orders. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction as aforesaid. It is further directed that in the event, the petitioners surrender within a fortnight from today before learned J.M.F.C. (R), Balasore in connection with Gopalpur P.S. Case No.0006 of 2026 corresponding to C.T. Case No.26 of 2026 and move regular bail, it shall be duly considered and in case rejected during the first hour, they shall approach the learned Sessions Court during the second hour for orders on the same day and for the said purpose, the relevant record shall be made available. It is further directed that the learned court below shall consider the plea of the petitioners regarding absence of antecedent and release of the co-accused persons, while passing orders. 6. Issue urgent certified copy of this order as per rules. (R.K. Pattanaik) Judge TUDU
