THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE B M SHYAM PRASAD - 4 - HC-KAR NC: 2026:KHC:80 WP No. 34828 of 2024 ORAL ORDER This petition is by two Russian citizens who travelled to India on an Employment Visa which, admittedly, was valid until 27.01.2025. The petitioners have invoked this Court's jurisdiction under Article 226 of the Constitution of India for directions to the first respondent to expeditiously process and re-issue fresh Visas to them. When queried, Sri Akhilesh, the learned counsel for the petitioners, submits that with the respective Visas expiring on 27.01.2025, the petitioners have flown back to their motherland and that the petitioners have filed an application for fresh Visas because they have been able to formalise a new contract for their employment in India. Sri H Shanthi Bhushan, the learned Deputy Solicitor General for the first to third respondents, submits that the petitioners were permitted to travel on Employment Visas because of a valid employment - 5 - HC-KAR NC: 2026:KHC:80 WP No. 34828 of 2024 contract but they are issued with 'Leave India Notice' because the employer terminated their contract, and the learned Deputy Solicitor General also submits that the petitioners cannot, as a matter of right, seek Visas. This Court opines that the petitioners' grievance with the Leave India Notice is rendered infructuous with they having flown back to their motherland and that if they intend to travel back to India, they must necessarily file an application as is required. When queried in this regard, Sri Akhilesh submits that the petitioners are willing to make an application to travel back to India because of the new employment contract that is now finalized with the prospective employer. In the light of the afore, the following: ORDER The petition stands disposed of with liberty to the petitioners to file applications for travel permit as is - 6 - HC-KAR NC: 2026:KHC:80 WP No. 34828 of 2024 permissible in law calling upon the respondents to consider the same expeditiously.
