For Petitioner : Mr.R.Sundar For Respondent No.1 : Mr.R.Ramasamy Counsel for the State of Tamil Nadu For Respondent No.2 : Mr.V.Balasubramanian O R D E R The present Writ Petition has been filed seeking for a direction to the second respondent to produce the original memorandum of deposit of title deed (document No.275 of 2006) at the time of registering the cancellation deed before the first respondent Sub-Registrar Office, in the light of petitioner's representation dated 06.05.2026. 2.Learned Counsel for the petitioner would submit that the property in Old S.F.No.524/8 part, New S.F.No.601/6, Sirupathur Village, Manachanallur Taluk, Trichy District, admeasuring 00229 sq.mt absolutely belongs to the petitioner, by virtue of a registered Will dated 07.01.2000 and patta has also been issued in favour of the petitioner. The petitioner had earlier pledged the said property with the second respondent bank and ____________ https://www.mhc.tn.gov.in/judis W.P.(MD)No.18355 of 2026 borrowed a sum of Rs.75,000/-, for which the petitioner executed a memorandum of deposit of title deed in favour of the second respondent bank which was registered before the first respondent on 15.02.2006 vide Document No.275 of 2006. Thereafter, the petitioner settled the entire loan amount along with interest and requested the second respondent bank to cancel the aforesaid deed executed on 15.02.2006. Thereafter, the petitioner presented a cancellation deed before the first respondent on 04.05.2026, which came to be refused. In this regard, the petitioner has sent a representation to the respondents on 06.05.2026. Since the said representation remains unconsidered, the present Writ Petition has been filed. 3.Learned Counsel for the second respondent Bank has produced an acknowledgment and submitted that the petitioner has received all the original documents on 20.01.2026. Hence, no further orders are required in this Writ Petition. 6.Accordingly, this Writ Petition stands disposed of, however, with a direction to the first respondent to carry out the necessary encumbrance in the property, upon perusal of the 'No-Due certificate' or 'No-Objection Certificate' from the second respondent Bank.
