This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed by the Applicant, who is apprehending his arrest in connection with Crime No.684/2025 registered at Police Station – SISTLA NEELIMA VISHNU PRIYA Digitally signed by SISTLA NEELIMA VISHNU PRIYA Date: 2026.02.13 19:40:02 +0530 2 Gandhinagar, District – Surguja (C.G.) for the offence punishable under Sections 75(2), 79 and 351(2) of BNS, 2023. 2. According to the prosecution’s case, the Applicant and the complainant, both mid-day meal cooks in the same primary school, were initially members of an organization for the welfare of such cooks. Later, they formed a new organization, with the complainant as President, the Applicant as Spokesperson, and the Applicant’s wife as Vice President. Being on friendly terms, the Applicant had lent money to the complainant for domestic purposes. Over time, differences arose regarding the organization’s functioning and collection of donations, which strained their personal and family relations. Allegedly, when the Applicant sought repayment of the loan, the complainant lodged a false case against him to evade her liability. Based on these allegations, offences as mentioned above have been registered against the present Applicant. Hence, this application. 3. Learned counsel for the Applicant submits that the Applicant is innocent and has been falsely implicated in the present case. It is further submitted that the victim and the Applicant are acquaintances and owing to a dispute over a loan, the victim has allegedly filed a false case against the 3 Applicant, therefore, he deserves to be granted the benefit of anticipatory bail. 4. Learned State Counsel opposes the grant of anticipatory bail to the Applicant on the ground that the allegations against him are serious and prima facie material indicates his involvement in the offence, therefore, his application for anticipatory bail may be rejected. 5. Upon hearing learned Counsel for the parties and perusing the record, this Court finds that the Applicant has been prima facie implicated in the present matter on account of a personal dispute over a loan. The material on record indicates that the allegations are not of a nature that would make custodial interrogation necessary at this stage. Considering the facts and circumstances, the nature of the dispute and in the interest of justice, the Applicant is held entitled to the protection of anticipatory bail without expressing any opinion on the merits of the case. 6. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the Applicant – Dhananjay Padamwar, on executing a personal bond with one surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- 4 (a) The Applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) The Applicant shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The Applicant shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d)The Applicant and the surety shall submit a copy of their adhaar card alongwith a colored postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
