Heard learned counsel for the parties.

The instant bail application has been preferred by the petitioner for grant of regular bail for the offences registered under Sections 64, 88, 89 of the BNS and under Sections 4 & 6 of the POCSO Act in connection with POCSO Case No. 25 of 2024 arising out of Bano PS Case No. 42 of 2024. In this case, charge has been framed under Sections 65(1), 88, 89 of the BNS and under Sections 4, 6 & 8 of the POCSO Act.

Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. Referring to annexure-3 to this bail application learned counsel for the petitioner submits that the victim has compromised with the petitioner and filed one compromise petition before the trial Court stating that she has solemnized marriage with the petitioner. As such, learned counsel for the petitioner submits that the petitioner may be enlarged on bail.

Learned counsel appearing for the informant supports the contention of learned counsel for the petitioner.

Having regard to the submissions made by learned counsel for the petitioner and also the victim relying upon Annexure-3 that petitioner and the victim have solemnized their marriage, the petitioner, above-

named, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand only) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge (POCSO), Simdega in connection with POCSO Case No. 25 of 2024 arising out of Bano PS Case No. 42 of 2024.

It is made clear that the petitioner shall appear on each and every date before the learned trial Court and he shall not threaten any witness and shall co-operate in trial and if any adverse report will come against the above-named petitioner, learned trial Court shall be at liberty to cancel the bail of the above-named petitioner.

Accordingly, the instant bail application stands allowed.
