HC-KAR NC: 2026:KHC:2964 WP No. 32748 of 2025 that the order in challenge is an order passed by the Assistant Commissioner under Section 136(2) of the Karnataka Land Revenue Act which is an order which can be revised before the Deputy Commissioner under Section 136 (3) of the Act. Learned counsel for the petitioner, however submits that a fraud has been played on the petitioner by the third respondent. Without impleading the petitioner, an order is obtained at the hands of the Assistant Commissioner. 3.
Having heard the learned counsel for petitioner and the learned High Court Government Pleader, this Court is of the considered opinion that when alternative efficacious remedy is available for the petitioner, the petitioner will have to go before the competent authority to redress his grievance. With these observations, the petition stands disposed of reserving liberty to the petitioner to approach the Deputy Commissioner to redress his grievance. Sd/-
