WP No. 19096 of 2026 PRAYER: The Writ Petition is filed under Article 226 of the Constitution of India seeking the issuance of a Writ of Mandamus directing the respondents 1 to 3 not to disburse the compensation amount to 4th respondent for the land in survey number 141/4 to an extent of 95 cents in Mahadevimangalam Village, Sriperumbudur Taluk, Kanchipuram District based on the petitioner’s objection / representation dated 24/03/2026 and consequently direct the respondents 1 to 3 to pay the compensation to the petitioner and other legal heirs of the late parthasarathy S/o.Sriniasa Nayakar within the time framed by this Court. The learned counsel for the petitioner submitted that the petitioner’s grandfather, namely Srinivasa Nayakkar S/o.Govinda Nayakkar, owned various properties across multiple survey numbers in Mahadevimangalam Village, Kancheepuram District. The petitioner’s grandfather had three brothers, namely: (1) Janakiraman Nayakar, (2) Thirumalai Nayakar, and (3) a deceased brother whose legal heirs are Gopalan and Nagapusanam. In the year 1945, the family properties in S.F. No. 141/4, totalling an extent of 5.26 acres, were partitioned among the petitioner’s grandfather and his brothers.
Out of the total extent, 1 acre and 11 cents were allotted to Varatharaja Nayakkar; 2.06 acres were allotted to Srinivasa Nayakkar; 1 acre and 12 cents were allotted to Janakiraman Nayakkar; and 1 acre and 3 cents were allotted to the petitioner’s grandfather. Except for the petitioner’s grandfather, all the other brothers sold their respective shares to the 4th respondent, Smt. Mariyammal, who thereby purchased a total of 3.34 acres of land in S.F. No. 141/4. By way of succession, the petitioner is in peaceful possession and enjoyment of his grandfather’s share, measuring an extent of 1 acre and 3 cents. While so, the Government acquired the subject lands for the expansion of the Parandur Airport. The 4th respondent is fraudulently claiming a right over the entire 5.26 acres of land and is attempting to receive the compensation for the entire extent from the official respondents. Consequently, the petitioner submitted an objection petition-cum- representation dated 24.02.2026, requesting that the compensation for the land measuring 1 acre and 3 cents in S.F. WP No. 19096 of 2026 respondent, and further praying that the said compensation be paid to the petitioner and the legal heirs of the late Parthasarathy, son of Srinivasa Nayakar. Since the said objection has not been considered till date, the petitioner has approached this Court. 3. The learned Government Counsel appearing for respondents 1 to 3 submitted that the petitioner’s objection will be considered by the 2nd respondent in accordance with law, after issuing due notice to the 4th respondent. 4. Heard both sides and perused the materials available on record. 5.
Under such circumstances, the 2nd respondent is directed to conduct a proper enquiry after issuing notice to the petitioner, the 4th respondent, and all other interested parties with regard to the disbursement of compensation specifically for the land in S.F. No. 141/4 to an extent of 1 acre and 3 cents, situated at Mahadevimangalam Village, Kancheepuram District. Thereafter, the 2nd respondent shall pass appropriate orders regarding the disbursement of compensation on merits and in accordance with law.
