AAG Ms. Ashima Das (Sil) ….. for the State. 1. Affidavit of service and supplementary affidavit filed in Court, are taken on record. 2. Heard the parties through their learned counsels. 3. The petitioner in the instant case prays, inter alia, for the following reliefs: a) A writ in the nature of Mandamus commanding the respondents including the respondents no.4 to take immediate steps to grant extension of the timetable dated 24.07.2025 for further period during validity of permit enabling the vehicle to ply uninterruptedly to render service to the commuters at large; b) Further Writ of Mandamus commanding the respondent authorities namely the respondent no.4 to ct strictly in accordance with 2 law in according extension of the timetable during validity of the stage carriage permit ensuring plying of the vehicle on the route under the scheme of the MV Act, 1988; c) A writ of Certiorari calling upon the respondents to produce or cause to be produced all records relating to the case of the petitioners before this Hon’ble Court so that conscionable justice may be done by passing appropriate order upon perusal of the same; d) Rule in terms of prayer (a) to (c) above; e) Interim order to injunction restraining the respondent authorities from causing any interference to plying of the vehicle baring no. WB 29A/3382 under PStP No.07/2025-26 during its validity as per timetable dt. 24.7.25 until extension is accorded pending hearing of the application in the Hon’ble High Court, Calcutta. f) Ad-interim order in terms of prayer (e)’ g) Pass such further order or orders, as Your Lordship may deem fit and proper: “ 4. Main grievance of the petitioner is with regard to the extension of the time table during the validity of the stage carriage permit which has been extended by the authorities up to 2030. 3 5. The writ petitioner in pursuance of the order dated 4.9.2025 passed by the Co-ordinate Bench of this Court, the time was extended by the authority concerned upto 4.11.2025. 6. Thereafter, the petitioner made an application on 29.10.2025 before the respondent no.4 for extension of the time table prior to the expiry of the extended period for extension of time table from Bitra to Memari via Bulbulitala, Debipur Station. But the same remains pending for consideration. 7. In the meantime, the petitioner files a supplementary affidavit annexing the decision of the respondent no.3 dated 29.09.2025, with an observation which is reproduced below: “Now, considering all of the above facts and circumstances, RTA, Purba Bardhaman in its meeting held on 24.09.2025 resolved that a 0further hearing is required in this regard. After further hearing decision will be taken in next RTA Board Meeting.” A copy of the supplementary affidavit is kept on record. 8. The petitioner submits that already the respondent no.3 has fixed the date of 4 hearing on a scheduled date i.e. 9th of January, 2026. 9. In view of the above, this Court directs the respondent no.3 to arrive at a decision on the event date that is on 9.01.2026 or any other date convenient to the authority concerned by passing a reasoned order in accordance with law upon affording an opportunity of hearing to the petitioner and communicate the same preferably within a week thereafter 10. In the meantime, the petitioner is directed to ply his vehicle in the said route on the basis of the approved time table till the decision taken by the authority concerned. 11. This writ petition is disposed of without going into the merits of the case. 12. With the above observations and directions, the writ petition, WPA 25672 of 2025 stands disposed of. 13.
