The learned Senior Counsel appearing for the petitioner submitted that the petitioner is a co-owner of a 10-acre joint property comprised in Survey Nos.84/1A and 84/1B, covered under Joint Patta No.767, situated at Thazhambur Village. The grievance of the petitioner is that, although the property continues to remain undivided, the fifth respondent illegally sub- divided the property as Survey No.84/1A2 and issued Patta No.4540 in favour of the transferee, contrary to Section 44 of the Transfer of Property Act, 1882, under which a transferee of an undivided share acquires only co-ownership rights and not any specific portion of the property. 3. He further submitted that the petitioner submitted representations and preferred a statutory appeal seeking cancellation of the illegal patta. Though the first respondent directed the competent authority to take appropriate action, no effective steps were taken. Aggrieved by the inaction of the respondents, the petitioner has filed the present writ petition seeking a Writ of Mandamus directing the respondents to consider the petitioner's representation and appeal, __________ Page3 of 7 https://www.mhc.tn.gov.in/judis https://www.mhc.tn.gov.in/judis WP No. 17310 of 2026 cancel Patta No.4540 and the illegal sub-division in Survey No.84/1A2, and restore the original Joint Patta No.767 in accordance with law. 4.
