ORAL JUDGMENT

1. It is submitted by the learned counsel for the appellants that the parties have settled their disputes inter-se and that a Compromise Petition is filed. The memorandum of the Compromise Petition reads as under:-
1. The Appellants/Defendants have agreed to pay a sum of Rs.60,00,000/- (Rupees Sixty Lakhs only) Respondents/Plaintiffs towards full and final settlement of the dues and in full satisfaction of the decree of the Trial Court. 2. Out of the total agreed settlement amount of Rs.60,00,000/-(Rupees Sixty Lakhs only), a sum of Rs 30,00,000/- (Rupees Thirty Lakhs only) is paid to Smt.Nagarathna (Respondent No.1/Plaintiff No.1) by way of Demand Draft bearing No.410418 dated 24.04.2026 for

Rs.27,00,000/- (less TDS) payable at Bank of Baroda, Vasanthnagar Branch towards her share and a sum of Rs 30,00,000/- (Rupees Thirty Lakhs only) is paid to Smt. M. N. Manjula (Respondent No.2/Plaintiff No.2) by way of Demand Draft bearing No.410417 dated 24.04.2026 for Rs.27,00,000/- (less TDS) payable at Bank of Baroda, Vasanthnagar Branch in the following manner: SL. NO. Particulars Unpaid Rents Interest Total 1 Smt. Nagarathna Rs.17,79,350/- Rs.12,20,650/- 30,00,000/- 2 Smt. M.N.Manjula Rs.17,79,350/- Rs.12,20,650/- 30,00,000/-
Note: Simple Interest on the rentals dues for the period from 15.11.2011 till 20.04.2026 at 6%, which works out to 15,41,161/- to each of the Plaintiffs, however, they have restricted the interest to a sum of Rs.12,20,650/-. 3. The appellants are entitle for release of the amount of Rs.50,00,000/- along with accrued interest for which the Respondents have no objection. 4. The appellants are also entitle for refund of admissible court fee paid on the above appeal for which the Respondents have no objection.”
2. The parties are also present before the Court and are duly identified by their respective counsel. The authorisations on behalf of the appellants are on record. 3. Having considered the contentions, the Compromise Petition is taken on record. The appeal is disposed of in terms of the compromise. Decree shall be drawn up accordingly. - 4 -

The amount of Rs.50,00,000/- (Rupees Fifty Lakhs Only) deposited before this Court pursuant to the order dated 21.10.2019 with accrued interest as well as the eligible Court Fee shall be refunded to the appellants, on proper identification. Sd/- (ANU SIVARAMAN) JUDGE
