The learned counsel for the petitioner is absent. 3. The case is a private complaint filed by the complainant for the offence under Section 138 of Negotiable Instruments Act. The case is sought to be quashed on the ground of compromise between the parties. 4. If joint compromise entered into between the parties, it will always open for the complainant to withdraw the complaint. This Court will not exercise extraordinary jurisdiction under 482 Cr.P.C/528 of BNSS as the private complaint filed by the parties can be withdrawn by the complainant itself. In view thereof, this Criminal Original Petition is disposed of with liberty to the parties to file appropriate application before the Trial Court for withdrawal of the complaint.
