Learned counsel for the petitioner submits that the petitioner is in custody since 09.07.2025 in connection with Chandwa P.S. Case No.138/2020 corresponding to S.T. Case No.242/2025, registered under Section 120B, 147, 148, 149, 353, 307 r/w 34 of the Indian Penal Code; Sections 25(1-A), 25(1-B)(a), 26, 27 r/w 35 of the Arms Act; and section 17 of the C.L.A. Act, now pending in the court of learned Addl. Sessions Judge – III, Latehar. 3. A supplementary affidavit has been filed by the learned counsel for the petitioner during the court proceedings, which is taken on record. 4. The learned counsel for the petitioner has submitted that the petitioner has voluntarily surrendered on 24.04.2025 under the Jharkhand Government Scheme of extradition and rehabilitation of left wing and thereby the petitioner has demonstrated his bonafide intention to return to the main stream and to cooperate with the administration. 5. The learned counsel for the petitioner has submitted that the petitioner has been kept in open jail and is being rehabilitated by the government. He submits that the petitioner has also been provided with several benefits as per the scheme. 6. The learned counsel for the petitioner has also submitted that several co-accused have been enlarged on bail including Babulal 2026:JHHC:7244 2 Ganjhu in B.A. No.426 of 2025; Raju Yadav in B.A. No.4099 of 2024; Baleshwar Ganghu in B.A. No.3150 of 2024; Vikash Kumar Thakur in B.A. No.1913 of 2021; Luxman Ganjhu in B.A. No.15298 of 2021; Sakender Ganjhu in B.A. No.2445 of 2022; Rakesh Ganjhu in B.A. No.4674 of 2024 and Ramesh Ganjhu in B.A. No.8774 of 2022. 7. The learned counsel for the State has opposed the prayer and submitted that the petitioner has as many as 8 criminal antecedents and merely because he has surrendered as per the scheme, the same may not be a ground to release the petitioner on bail. He has also submitted that the petitioner is active member of banned TSPC organization and from the place of occurrence, huge quantity of arms and ammunition and other Naxal articles were recovered. 8. After hearing the learned counsel for the parties and considering the numerous criminal antecedents of the petitioner, this Court is not inclined to enlarge the petitioner on bail. As submitted by the learned counsel for the petitioner, the petitioner is already undergoing rehabilitation under the scheme of the government. 9. The bail application is rejected. 10.
