For Petitioner(s): Mr.N.Desinghu For Respondent(s): Mr.K.Raja, Standing Counsel https://www.mhc.tn.gov.in/judis WP No. 25683 of 2026 __________ Page2 of 5 ORDER This Writ Petition has been filed for the following reliefs:- “directing the respondents to pay the belated payment of interest on the differential amount of Commutation and Earned leave Salary (EL and ML ) and other benefits of Surrender Leave salary for the year 2010- 2012 the recovery of PF amount along with interest at the rate of 12 percent and considering the petitioner representation dated 31.01.2026 within the stipulated time as may be fixed by this Honble court..” 2. It is the case of the petitioner that he had joined the services of the respondent Corporation on 19.12.21983 and retired from service on 28.02.2017. However, his terminal benefits were settled belatedly as per the last drawn salary at the time of retirement. Further, the petitioner retired from service prior to the implementation of the 7th Pay Commission, which came into effect on 01.01.2017. As per the recommendations of the 7th Pay Commission, the petitioner is entitled to revision of pay and the consequential revision of terminal benefits, such as difference in leave salary and Commutation. However, the said benefits have not been extended to the petitioner. That apart, others benefits such as surrender leaver salary and recovery amount of PF has not been paid to the petitioner. Since the said representations were not considered, the present Writ Petitions have been filed. 3. The learned Standing Counsel for the respondents submitted that they are willing to pay the eligible and admissible differential amount of terminal benefits as per the 7th Pay Commission, along with interest at 6% per annum. They also agreed to settle the other eligible benefits due and payable to the petitioner with 6% interest. 4. Heard the learned counsel for the petitioner and the learned Standing Counsel appearing on behalf of the respondents. 5. In view of the above submission of the learned Standing Counsel, this Court deems it appropriate to direct the respondents to pay eligible differential amount of terminal benefits such as leave salary and Commutation, as per the 7th Pay Commission along with interest at the rate of 6% per annum from the date on which the amounts became due till the date of actual payment. The respondents are also directed to settle the other eligible benefits due and payable to the petitioner along with interest at the rate of 6% per annum from the date on which the amounts became due till the date of actual payment.
