This criminal miscellaneous petition has been filed invoking the jurisdiction of this Court under Section 482 of the Cr.P.C. with the prayer to quash the entire criminal proceedings including the order taking cognizance and order issuing summons dated 10.02.2017, passed by the learned Judicial Magistrate -1st Class, ( 2026:JHHC:8156 ) 2 Cr.M.P. No.3920 of 2023 Ranchi in Complaint Case No. 3100 of 2014 for the offences punishable under Section 417/323/504 of the Indian Penal Code. 3. Perusal of the record reveals that vide the said order, prima facie case has been found by the learned Magistrate against the Manager of Magma Finance Limited and Magma Sorakshi Finance Company Limited and two other persons namely Agent Ram Dinesh Bhagat and Agent Tarak. This petition has been filed by Poonawalla Fincorp Limited Formerly known as Magma Fincorp Limited. A supplementary affidavit has been filed by the petitioner that Magma Fincorp Limited was popularly known as Magma Finance Limited and Magma Sorakshi Finance Limited has wrongly been mentioned as Magma Sorakshi Finance Company Limited. Since the learned Judicial Magistrate has found prima facie case against the Manager, Magma Finance Limited and Magma Sorakshi Finance Company Limited, it is only the Manager –Magma Finance Company Limited and Magma Sorakshi Finance Limited Company or the other two persons namely Agent Ram Dinesh Bhagat and Agent Tarak are the aggrieved persons in respect of the said case but it appears that the petitioner is none of them. 4. So, this Court is of the considered view that since the petitioner is not admitting that it is the accused person of the case being Magma Finance Limited and Magma Sorakshi Finance Limited, hence the petitioner has no locus-standi to make the prayer as prayed for in this criminal miscellaneous petition.
