……for the State. Learned advocate appearing for the petitioner submits that the petitioner is in custody for two years seven months and has prayed for renewal of his bail. It has also been contended that two witnesses till date have been examined out of the thirteen witnesses cited by the prosecution. Learned advocate for the State opposes the prayer for bail and draws the attention of the Court to the statement of the victim as well as the medico legal examination report. I have taken into account the progress of the trial of the case and is of the opinion that there is no possibility of the trial being concluded within a reasonable period of time. Having regard to the same, I am of the view that the petitioner be released on bail. Accordingly, petitioner namely, Piyus Roy shall be released on bail upon furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand
2 only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Judge, Special Court under POCSO Act, Barrackpore, North 24 Parganas. If on bail, the petitioner shall be physically present on each and every date fixed by the learned trial Court and shall not leave the jurisdiction of District of North 24 Parganas without the prior permission of the learned trial Court. Further, petitioner shall not enter the jurisdiction of Basudebpur Police Station for a period of six months and after that it would be the discretion of the trial Court to allow or disallow to enter the jurisdiction of the same. Accordingly, the application for bail being CRM (M) No. 378 of 2026 is allowed. Service report submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
