Respondents Prayer: Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Certiorarified Mandamus calling for the records relating to the proceedings initiated by respondents No.1 and 2 under the SARFAESI Act namely the order dated 28.11.2025 passed in Crl.M.P.No.346 of 2025 by the 4th respondent, the auction sale conducted on 07.08.2025 and the sale certificate dated 19.08.2025 registered as document No.2595 of 2025 dated 29.10.2025 on the file of the 5th respondent and quash the same insofar as they purport to include, affect or convey the petitioner’s right, title and interest over the built-up area measuring 355.75 square feet in building in the larger extent measuring 2,466 square feet out of the total extent of 0.06-11/16 acres, together with the buildings bearing Door Nos.15-B and 15-C, comprised in R.S.No.1651 and T.S.No.B/7/62, Mount Road, Coonoor and consequently direct Respondents 1 to 5 and 10 not to dispossess or interfere with the petitioner’s peaceful possession and enjoyment of the said property except under due process of law.
