Upon considering the nature of allegations it is stated that the petitioners kicked the iron sheet which was kept as a fencing in the property and the same fell on the defacto complainant and caused injuries 3. The learned counsel for the petitioner submit that the entire allegations are incorrect and would contend that the petitioner is not guilty. The contention of the petitioner can be taken only during the Trial before the Court concerned. 4. At this juncture the learned counsel for the petitioner submit that there is grave hardship for the petitioner to appear before the Trial Court for every hearing. Considering the plea made the petitioner appearance before the Trial Court is dispensed with except for the hearing that are insisted by the Trial Court. 5.
