P.Vijendran For Respondent(s): MR.N.PALANIVEL, GOVT.ADVOCATE (CRL.SIDE) https://www.mhc.tn.gov.in/judis CRL OP No. 17291 of 2026 __________ Page2 of 4 ORDER The petitioner apprehends arrest for the alleged offences under Sections 296(b), 115(2), 118(1), 109, 351(3) of BNS 2023 in Crime No.234 of 2026 on the file of the respondent police seeks anticipatory bail. 2. The case of the prosecution is that the petitioner along with other accused persons assaulted the defacto complainant with hands and wooden log and caused grievous injuries. Hence the complaint. 3. The learned counsel appearing for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case. He further submitted that he has not committed any offence as alleged by the prosecution and that he is ready to abide by any conditions that may be imposed by this Court. Hence, he prays to grant anticipatory bail to the petitioner. 4. Per contra, the learned Government Advocate (Crl.Side) appearing for the respondent strongly opposed the grant of anticipatory bail to the petitioner on the ground that the petitioner has got 4 previous cases pending against him. https://www.mhc.tn.gov.in/judis CRL OP No. 17291 of 2026 __________ Page3 of 4 5. From the submissions made by the learned Government Advocate (Criminal Side), it is seen that the petitioner has previous cases against him, which clearly demonstrates that whenever he was granted anticipatory bail by the courts, he misused the liberty granted to him. In view of the same, if the petitioner is enlarged on anticipatory bail, he may be emboldened to indulge in similar offences in the future without fear of the law. Hence, taking into consideration the interest of society at large, this Court is not inclined to enlarge the petitioner on anticipatory bail. 6.
