and all other revenue records in the name of the petitioner in respect of 5 acres 12 cents in Sy.No.861 of Cowdalli Village, Ramapura Hobli, Hanur Taluk, Kollegal Sub Division, Chamrajanagar District and 5 acres 27 cents in Sy.No.863 of the same village.
3.
Learned counsel for the petitioner has drawn the attention of this Court to Annexure-L, the communication dated 01.12.2022 made by the Tahasildar to the Assistant Commissioner, Kollegal Sub-division, where the Tahsildar after verifying the records has found that in the original revenue records, Survey No.861 and Survey No.863 has the name of Sri K.Mujeer. However, in column No.12, the person in occupation was shown as Shiva Jamadar and K. Mujeer. In the subsequent records, in Column No. 9, it was shown as, ‘sarkari tarasu’. Having regard to the report submitted by the Tahsildar, in an appeal preferred before the Assistant Commissioner in proceedings bearing No.LND/vicharane/CR/33/2022-2023, the Assistant Commissioner directed the Tahsildar to re-

verify from the records and take appropriate action, if it is found that the name of Sri K.Mujeer and K. Abdul Mujeer is required to be re-entered in the revenue records. In the meanwhile, one Yaseen, S/o Abadul Jabbar approached the Deputy Commissioner in R.A.No.91/2022-2023 and the Deputy Commissioner passed an order on 08.08.2024 once again directing the Tahsildar to verify from the records and take action in accordance with law.
4.
Learned counsel for the petitioner submits that despite such directions being issued by the Deputy Commissioner, the Tahsildar has taken no further steps to redress the grievance of the petitioner.
5. In the considered opinion of this Court, it would be a futile exercise to once again direct the Tahsildar to consider the representation given by the petitioner. In law, having regard to the powers conferred on the Assistant Commissioner under Section 136(2) of the Karnataka Land Revenue Act, the Assistant Commissioner is duty bound to

consider the appeal that would be filed by the petitioner, call for original records, peruse the same and if necessary call for any documents at the hands of the petitioner and issue notice to all concerned and thereafter consider the matter on merits and pass appropriate orders in accordance with law. Neither the Assistant Commissioner nor the Deputy Commissioner could have remanded the matter back to the Tahsildar for reconsideration.
6. In that view of the matter, the writ petition stands disposed of with a direction to the Assistant Commissioner to reopen the appeal in LND/vicharane/CR/33/2022-2023, implead all other persons who may have any claim in respect of the land in question, consider the inter se claim between the parties and pass appropriate orders in accordance with law to enable the Tahsildar to enter the names of the persons who are legally entitled to have their names entered in the revenue records.
