CRL OP No. 17306 of 2026 __________ Page2 of 5 ORDER The petitioner apprehends arrest for the alleged offences under Sections 8(c), 20(b)(ii)(B) and 22(b) of the NDPS Act 1985, as amended by Act 9/2001 in Crime No.196 of 2026 on the file of the respondent police seeks anticipatory bail. 2. The case of the prosecution is that the petitioner was in illegal possession of Ganja weighing 1.265 Kg. Hence the complaint. 3. The learned counsel appearing for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case. He further submitted that he has not committed any offence as alleged by the prosecution and that he is ready to abide by any conditions that may be imposed by this Court. Hence, he prays to grant anticipatory bail to the petitioner. 4. The learned Government Advocate (Criminal side) strongly objected to enlarge the petitioner on bail on the ground that there are eight previous cases pending against the petitioner. https://www.mhc.tn.gov.in/judis

5. From the submissions made by the learned Government Advocate, it appears that this case is arising out of NDPS Act. Further it is amply clear from the submissions made by the learned Government Advocate that whenever the petitioner is enlarged on bail, he had misused the liberty granted to him and again committed similar nature of offences. In such view of the position and taking into consideration of the interest of society at large, this Court is not inclined to enlarge the petitioner on bail at this juncture.
Further the petitioner is having eight previous cases in his credit, which also vindicates the dismissal of this petition. 6. Accordingly, this criminal original petition is dismissed. 07-07-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No MFA https://www.mhc.tn.gov.in/judis
