HC-KAR NC: 2026:KHC:5206-DB CCC No. 1339 of 2025
THIS CCC IS FILED UNDER SECTION 11 AND 12 OF THE CONTEMPT OF COURT ACT, 1971, PRAYING TO INITIATE CIVIL CONTEMPT PROCEEDINGS AGAINST THE ACCUSED FOR WILLFULLY DISOBEYING THE ORDER PASSED BY THIS HON'BLE COURT DATED 16.09.2025 IN W.P. NO.25032/2025 (LB-BMP) AT ANNEXURE-A & ETC. THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER:
CORAM: HON'BLE MR. VIBHU BAKHRU, CHIEF JUSTICE and HON'BLE MR. JUSTICE C.M. POONACHA
ORAL ORDER (PER: HON'BLE MR. VIBHU BAKHRU, CHIEF JUSTICE)
1. The complainant has filed the present complaint alleging willful disobedience of the order dated 16.09.2025 passed by the learned Single Judge of this Court in WP.No.25032/2025 (LB-BMP), whereby the Department of Forest, BBMP was directed to hear the complainant as well as Sree Muneshwaraswamy Temple Trust (arrayed as respondent No.3 in the writ petition) and do the needful. 2. The accused submits that hearing was afforded. However, no action could be taken to cut down the tree as respondent No.3 had not consented to the same. The controversy relates to a tree

which is growing in the precincts of a temple as is, effectively, destroying the house property of the complainant. The complainant seeks that the steps be taken to cut certain branches of the tree in order to protect his property. The accused has no objection for granting the permission.
However, since the tree is in the compound of the adjoining temple, the complainant is reluctant to cut down the branches of the tree, as that may result in friction with the temple authorities. 3. In view of the given facts, we are unable to accept that any proceedings are required to be initiated for willful disobedience of the order of the Court. The complaint is accordingly closed. 4. We, however note that the complainant's grievance survives and this order will not preclude the complainant from availing his remedies as available under law. Sd/- (VIBHU BAKHRU) CHIEF JUSTICE
Sd/- (C.M. POONACHA) JUDGE
