THIS PETITION, COMING ON FOR ADMISSION, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE V SRISHANANDA ORAL ORDER Parties are present. Joint memo is filed. Contents of the joint memo reads as under: “We the undersigned have entered into compromise and in terms of compromise the petitioner herein have agreed to pay the amount of Rs.16,50,000/-(Sixteen Lakhs fifty thousand rupees) as full and final settlement to the respondent. Out of which the amount of Rs.5,00,000/- has been deposited before the trial Court and the Respondent shall withdraw the same and further balance amount of Rs.11,50,000/- shall be payable by the petitioner to the respondent as follows:- (i) The amount of Rs.4,00,000/- (Four Lakhs rupees) shall be payable by the petitioner to the respondent on or before 25.04.2026. (ii) The amount of Rs.4,00,000/- (Four Lakhs rupees) shall be payable by the petitioner to the respondent on or before 25.05.2026. (iii) The amount of Rs.3,50,000/- (Three Lakhs Fifty thousand rupees) shall be payable by the - 3 - HC-KAR NC: 2026:KHC:17376 CRL.RP No. 1142 of 2022 petitioner to the respondent on or before 25.06.2026. If the petitioner fails to comply with the terms of compromise and fails to pay the aforesaid amount as stated in the Joint memo, the Respondent is at liberty to recover the said amount through the Process known to Law with damages at the cost of petitioner.” 2. Placing the memo on record, petition stands disposed of. 3. Amount in deposit is ordered to be withdrawn by the complainant under due identification. 4. It is made clear that if the compensation amount as agreed in the joint memo is not paid, petitioner shall undergo imprisonment as ordered by the learned Trial Magistrate, confirmed by the First Appellate Court. 5.
