PUBLIC PROSECUTOR 3 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL PETITION NO: 2693/2026 ORDER: The Criminal Petition, under Section 482 of BNSS, is filed on behalf of the petitioner herein/Accused No.2, seeking to grant anticipatory bail in connection with Crime No. 23 of 2026 of Tirpuranthakam Police Station, Markapuram District, registered for the offence punishable under Section 109 (1) read with 3 (5) of Bharatiya Nyaya Sanhita, 2023 (for short ‘BNS’). 2. The case of the prosecution, in brief, is that on 01.03.2026, at about 10:00 AM, due to previous disputes relating to agricultural land, the accused along with other co-accused, attacked the complainant’s party with sticks and a sickle. During the incident, the injured persons sustained head and hand injuries. It is further alleged that A.5 attacked the complainant with a sickle with an intention to kill him, causing bleeding injuries. 3. Heard Sri R.Yella Reddy, learned counsel for the petitioner/accused No.2, and Mrs.K.Priyanka Lakshmi, learned Assistant Public Prosecutor representing on behalf of the State. 4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated as Accused No.2 in the present case and that he is innocent. It is contended that the case has been foisted only to harass the petitioner. He would further submit that there are civil disputes between the petitioner’s family and the complainant. Learned counsel also submits that the 4 petitioner/Accused No.2 sustained injuries and underwent surgery. As per the contents of the complaint, it is alleged that he, along with the other accused, beat the complainant with hands and legs. It is further submitted that though the petitioner lodged a complaint, no case was registered against the complainant. He also submits that the petitioner is ready and willing to furnish sufficient sureties to the satisfaction of the learned Trial Court to secure his presence for the purpose of investigation. 5. Learned Assistant Public Prosecutor vehemently opposed the petition and submitted that there are specific allegations against the petitioner. It is further submitted that the investigation is still pending, particularly with regard to the examination of the injured and other material witnesses. If the petitioner is released on anticipatory bail, there is every likelihood that he may tamper with the evidence or hamper the ongoing investigation. She therefore prays for dismissal of the petition. 6. Considering the submissions made and upon perusal of the material on record, it appears that there are disputes between the petitioner and the complainant. Further, it is stated that the petitioner also sustained injuries and underwent surgery. In that view of the matter, and having regard to the stage of the investigation, this Court is inclined to grant anticipatory bail to the petitioner/Accused No.2. 7. In the result, the Criminal Petition is allowed with the following conditions: 5 (i) The Petitioner / Accused No.2 shall appear before the concerned Jurisdictional Court, within one (01) week from today and shall furnish personal bond for Rs.20,000/- (Rupees twenty thousand only) with two sureties for the like sum each, to the satisfaction of said Court. (ii) The Petitioner / Accused No.2 shall cooperate with the investigation and appear before the Investigating Officer as and when required. (iii) The Petitioner / Accused No.2 shall not directly or indirectly threaten or influence the witnesses. (iv) The Petitioner / Accused No.2 shall not tamper with the evidence in any manner. (v) The Petitioner / Accused No.2 not leave India without prior permission of the Court. (vi) The Petitioner / Accused No.2 appear before the Station House Officer concerned once in a week, i.e., on every Sunday between 10:00 AM and 5:00 PM, till filing of charge sheet. (vii) The Petitioner / Accused No.2 shall surrender his passport, if any, to the concerned Court. If he claims that he does not have a passport, he shall submit an affidavit to that effect to the concerned Court 8. In the event of violation of any of the above conditions, the prosecution shall be at liberty to seek cancellation of bail. 9. It is also made clear that the observations made in this order are only for the purpose of deciding the bail application and they shall not be construed as opinion on the merits of the Crime. 6 10. Accordingly, this Criminal Petition is allowed. As a sequel thereto, the miscellaneous applications, if any, pending in this Criminal Petition shall stand closed. __________________________________________ DR.
