The allegation against the petitioner is that the petitioner, along with the other accused, attempted to commit dacoity. Hence, the case. 3. The learned counsel appearing for the petitioner would submit that the petitioner is innocent and has been falsely implicated in this case. He would further submit that the petitioner has been in custody since 23.05.2026 and that, in any event, his further custody is not required for the purpose of investigation. It is the specific submission of the learned counsel for the petitioner that the co- accused have already been enlarged on bail. Hence, he prayed for grant of bail on the ground of parity. 4. The learned Government Advocate (Crl. Side) appearing for the respondent police, while opposing the grant of bail, reiterated the prosecution case and, on instructions, submitted that the petitioner has seven previous cases, out of which five are for robbery, one is under the NDPS Act and one relates to an offence of harassment of women, and that the investigation is still pending. It was further submitted that though the co-accused were enlarged on bail, they had no criminal antecedents, whereas the petitioner has seven previous cases. Considering the submission of the learned Government Advocate (Crl. Side) that the investigation is still pending, the past criminal antecedents of the petitioner, the fact that the co-accused, who were enlarged on bail, had no criminal antecedents and, therefore, the petitioner cannot claim parity with them, and having regard to the nature of the allegations, this Court is of the view that it would not be appropriate to grant bail to the petitioner at this stage. 6.
