For Petitioner(s): Mr. K.V.Sajeevkumar For Respondent(s): Ms.Inthu Karunakaran Government Counsel for R1 and R2 For R3 – Notice Served – No appearance ORDER The present Writ Petition has been filed seeking the issuance of a Writ of Mandamus directing the 1st respondent to comply with the proceedings of the 2nd respondent dated 09.06.2025. 2. The case of the petitioner is that she submitted a legal notice dated 20.03.2026 to the 1st and 2nd respondents requesting issuance of a computerized patta in respect of an extent of 1,680 sq. ft. in Town Survey No.53/0, Door No.54 (New Door No.41), Sardar Patel Road, Guindy, Chennai–32, comprised in T.S.No.94 (Patta T.S.No.94/5), Block No.6, Venkatapuram Village, New Block No.38, New T.S.No.53, based on the proceedings of the Tahsildar, Guindy, dated 09.06.2025. Aggrieved by such inaction, the petitioner has filed the present Writ Petition. 3. It is the further case of the petitioner that, during the enquiry conducted by the 2nd respondent, the representatives of the 3rd respondent categorically stated that the subject property does not belong to them, that the alleged overlap has no basis, and that they do not possess any document to establish title or entitlement over the extent claimed by the petitioner. 4. It is further submitted that the Tahsildar, Guindy, after considering the documents produced by the petitioner, the submissions of the parties, and the report of the Surveyor, recommended subdivision of T.S.No.53/0 and addressed a communication dated 09.06.2025 to the 1st respondent recommending transfer of patta in favour of the petitioner by effecting the necessary subdivision from the holding standing in the name of the 3rd respondent. 5. In view of the categorical stand taken by the 3rd respondent before the revenue authorities that the subject property does not belong to them and that they have no documents to substantiate any claim over the property, coupled with the recommendation made by the Tahsildar, Guindy, dated 09.06.2025 for __________ Page3 of 5 https://www.mhc.tn.gov.in/judis WP No. 19155 of 2026 issuance of patta in favour of the petitioner, this Court is of the view that the petitioner's request deserves consideration. Accordingly, the 1st respondent/Revenue Divisional Officer is directed to consider the petitioner's request for issuance of a computerized patta, taking into account the proceedings of the Tahsildar, Guindy, dated 09.06.2025, and pass appropriate orders on merits and in accordance with law, after affording an opportunity of hearing to all necessary parties, within a period of six (6) weeks from the date of receipt of a copy of this order. 6.
