No. 1494 of 2026 __________ IN THE HIGH COURT OF JUDICATURE AT MADRAS DATED: 16-07-2026 CORAM THE HON'BLE DR.JUSTICE ANITA SUMANTH AND THE HON'BLE MR.JUSTICE SUNDER MOHAN WP Crl. No. 1494 of 2026 AND WPMP CRL. NO. 520 OF 2026 Podhumalli W/o. Ravichandran (Late), No.45, Jayasimmapuram, Papanayakkampalayam, Coimbatore - 641 037. ..Petitioner(s) Vs
1. The Deputy Inspector General of Prison, Coimbatore Range, Coimbatore. 2. The Superintendent of Prisons, Central Prison, Coimbatore. ..Respondent(s) Prayer: Writ petition filed under Article 226 of Constitution of India to issue a Writ of Certiorarified Mandamus calling for the records in the order No.119/tha.u.1/2026 dated 12.06.2026 passed by respondent No.1 and quashing the same and consequently directing the respondents to grant 28 days ordinary leave by without escort for the petitioner’s son namely Arun @ Arunpandi S/o, Ravichandiran aged about 30 years, Pid No.16046, Convict Prisoner, Central Prison, Coimbatore. https://www.mhc.tn.gov.in/judis
2026:MHC:2830 WP Crl. No. 1494 of 2026 __________ For Petitioner(s): Ms.S.Nadhiya For Respondent(s): Mr. C.R. Malarvannan Counsel For Government Of Tamil Nadu (criminal Side) Order (Order of the Court was made by Dr.Anita Sumanth J.) Heard Ms.S.Nadhiya, learned counsel for petitioner and Mr.C.R.Malarvannan, learned counsel for Government of Tamil Nadu (Criminal Side) for respondents. 2. The challenge is to the condition of escort imposed under order dated 12.6.2026 while granting 28 days ordinary leave to a convict Arun @ Arunpandi, lodged in Central Prison, Coimbatore. 3. We find from the record that this is not the first instance where the convict has availed leave. In fact, by the intervention of this court in WP 35338/2025 dated 3.12.2024, he has availed leave of 28 days without escort already. 4. Mr.Malarvannan too, on instructions, does not have any serious objections to the removal of the condition relating to escort perhaps for the reason that neither police authorities nor the probation officer have pointed to any untoward conduct of the convict necessitating escort. https://www.mhc.tn.gov.in/judis
2026:MHC:2830 WP Crl. No. 1494 of 2026 __________
5. The order of the probation officer which we have called for by way of abundant caution also reveals that there is no reason justifying the imposition of condition for escort. In such circumstances, leave granted under order dated 12.6.2026 shall be availed by the convict without escort. 6. This writ petition stands allowed in terms of this order. No costs.
