Petitioner has filed this writ petition seeking following reliefs:- 2 / 3 “10.1 That this Hon’ble court may kindly be pleased to call for entire record pertaining the land acquisition proceedings from the respondent for its kind perusal. 10.2 That, this Hon’ble Court may kindly be pleased to pass an appropriate writ declaring the land acquisition proceeding pertaining to case no. 48/v-82/2012-13 as having lapsed. 10.3 This Hon’ble Court may kindly be pleased to pass an appropriate writ quashing and setting aside the entire land acquisition proceeding bearing case no. 48/v-82/2012-13. 10.4 Any other relief which this Hon’ble Court may deem fit and proper in the facts of the case.” 2. Learned counsel for petitioner submits that in view of pleadings made in para no. 6 of the reply of State where it is stated that earlier proceedings have been elapsed and respondent authorities are going to initiate the fresh land acquisition proceedings under the Right to Fair Compensation & Transparency in Land Acquisition, Rehabilitation & Resettlement Act, 2013, the prayer in the writ petition has rendered infructuous. 3. Relevant para is extracted below for ready reference:- “6. That the State has initiated acquisition of the land in question on 20.03.2012 and a notification under Section 4 of the Act, 1894 was published on 29.03.2013. Thereafter, the respondent authority did not initiate further proceedings regarding the requirement of the land, due to which the acquisition proceedings have now lapsed. However, the respondent authorities have again initiated steps to acquire the land for establishment of an airport. In this regard, the Aviation Department has issued a letter to the Collector, Raigarh (CG) on 06.11.2025, wherein the Aviation Department has requested acquisition of land for the 3 / 3 establishment of the airport. On consideration of the letter dated 06.11.2025, the respondent authority initiated a survey to acquire the land as per the requirements of the Aviation Department. Now, the respondent authority is proceeding to acquire the land in question along with other adjoining the land for establishment of the airport; therefore, the previous acquisition proceedings stand lapsed. The respondent authority conducted survey for acquisition and is going to initiate acquisition proceedings under the New Land Acquisition Act, 2013. A copy of the letter dated 06.11.2025 is filed and annexed herewith as Annexure R/1.” 4. In view of submission made by counsel for petitioner based on para no. 6 of reply of State, this writ petition stands dismissed as rendered infructuous. Certified copy as per rules.
