JUSTICE SANDEEP TANEJA Order 25/02/2026 1. This bail application has been filed by the accused-petitioner under Section 483 of B.N.S.S. in connection with F.I.R. No.102/2024, registered at Police Station Dihauli, District Dholpur, for the offence(s) punishable under Section(s) 147, 148, 149, 332, 353 & 307 I.P.C. and Section 11 of the R.D.A. Act. 2. Learned counsel for the petitioner submits that the accused- petitioner has been falsely implicated in this case and he has nothing to do with the alleged offences. Learned counsel further submits that no injury has been caused to any person during the alleged incident and the other co-accused persons have already been enlarged on bail by Co-ordinate Benches of this Court. Learned counsel also submits that the petitioner is in custody since 22.01.2026, no recovery is required to be made from him; charge-sheet has already been filed in the matter and trial will take considerably long time in its conclusion, so no fruitful purpose [2026:RJ-JP:8749] (2 of 3) [CRLMB-2746/2026] would be served by keeping the petitioner in custody, therefore, the benefit of bail under Section 483 B.N.S.S. may be granted to the accused-petitioner. 3. Per contra, learned Public Prosecutor opposes the submissions made by learned counsel for the petitioner hereinabove and submits that the petitioner, being a habitual offender, has seven other criminal cases pending against him. 4. Taking into consideration the overall facts and circumstances of the case; considering the arguments advanced by learned counsel for the petitioner, the fact that it is a case of no injury; the other co-accused persons have already been granted bail by Co-ordinate Benches of this Court, charge-sheet has already been filed in the matter and trial will take considerably long time in its conclusion, thus, without commenting anything on the merits / demerits of the case, this Court deems it just and proper to enlarge the petitioner on bail. 5. Therefore, the bail application under Section 483 B.N.S.S. is allowed and the accused-petitioner, namely Tehsila @ Tehsildar S/o Soneram, is ordered to be released on bail, provided he furnishes a personal bond in the sum of Rs.5,00,000/- with two sureties of Rs.2,50,000/- each to the satisfaction of the Trial Court, with the stipulation that the petitioner shall appear before that Court on all subsequent dates of hearing and as and when he is called upon to do so. 6. It is made clear that the accused-petitioner shall not involve in any other offence(s) during currency of the bail and he shall [2026:RJ-JP:8749] (3 of 3) [CRLMB-2746/2026] mark his presence in first week of every month in the concerned police station, till trial is concluded. 7. Concerned SHO is directed to maintain a register recording the attendance of the petitioner, as directed above. In case the petitioner fails to mark his presence in the concerned police station, as directed above, the concerned SHO is directed to immediately report the matter to the concerned Court in this regard. 8. If any breach of these conditions is reported or come to the notice of the Court, the same shall alone be a reason for the Trial Court to cancel the bail granted to him by this Court. 9. Office is directed to send copy of this order to the concerned SHO for necessary compliance. 10.
