“ directing the Respondents to pay the petitioner a sum of Rs.14,442 /- towards arrears of difference in Surrendered Earned Leave/ Medical leave, to pay the petitioner a sum of Rs.22,800 /- towards arrears of Dearness Allowance, to pay the petitioner a sum of Rs.36,087/- towards arrears of difference in Surrendered Earned Leave/ Medical Leave to pay the petitioner a sum of Rs.18,500 /- towards the amount payable under the Post Retirement Benefit Fund Scheme, to pay the petitioner a sum of Rs.4,500/- towards the IRT Contributions, to pay the petitioner the amount payable under the family benefit Fund scheme, together with interest at the rate of 12 percent per annum and to pay the petitioner interest at the rate of 12 percent per annum for the belated payment of Rs.5,54,671 /- towards Surrender Earned Leave wage within a specified time frame, as may be fixed by this Honble court, Award Cost..” https://www.mhc.tn.gov.in/judis

2. It is the case of the petitioner that he joined the services of the respondent Corporation on 01.08.1986 and retired from service on 30.04.2019. However, his terminal benefits were settled belatedly without payment of any interest. Further, the amounts payable under the Family Benefit Fund, the Post Retirement Benefit Fund Scheme, 1992, and IRT Contributions have not been paid to him. Therefore, the petitioner had sent representations to the respondent which evoked no response so far. Hence, the present Writ Petition has been for the reliefs stated supra. 4. The learned Standing Counsel for the 1st respondent submitted that they are willing to pay interest at 6% per annum on the delayed payment of the petitioner’s eligible and admissible terminal benefits. They also agreed to disburse all other eligible and admissible unsettled terminal benefits due to the petitioners, together with interest at the rate of 6% per annum. 5. Heard the learned counsel for both sides and perused the materials available on record. 6.
In view of the above submission of the learned Standing Counsel, this Court deems it appropriate to direct the respondents to pay interest at the rate of 6% p.a. for the belated payment of terminal benefits from the date of retirement till the date of actual disbursal of the terminal benefits to the petitioner and to https://www.mhc.tn.gov.in/judis
WP No. 25334 of 2026 __________ Page4 of 7 disburse all the other eligible unsettled terminal benefits due to the petitioner along with interest at the rate of 6% per annum for the delayed period. The said exercise shall be completed within a period of six weeks from the date of receipt of a copy of this order. 7. Accordingly, the Writ Petition is disposed of.
