Heard Ms.Janani Shankar, learned counsel for the petitioner. 3. From a reading of the Sub-Concession Agreement dated 25.06.2025 entered into between the petitioner and the respondent, it could be seen that the parties have agreed to resolve their disputes by appointing an Arbitrator. The petitioner issued a formal notice in December 2025, calling upon the respondent to mutually appoint a Sole Arbitrator. In spite of the same, the respondent has not chosen to respond. 4. However, when the matter was taken up for hearing today, Mr.S.Aswinraj, learned counsel appearing for the respondent would submit that he has no objection for appointment of an Arbitrator to enter upon the dispute that had arisen between the parties. https://www.mhc.tn.gov.in/judis Arb.O.P(COM.DIV.)No.337 of 2026 __________ Page3 of 5 5. In view of the Sub-Concession Agreement and considering the nature of claim, this Court deems it appropriate to appoint an Arbitrator. Accordingly, Mr.K.Harishankar, Advocate, (Mobile No.98410 76561), having office at ‘Capitale’ 9th Floor, No.554/555, Anna Salai, Teynampet, Chennai – 600 018, is appointed as Sole Arbitrator to enter upon the reference and resolve the disputes between the petitioner and the respondent. 6. The learned Sole Arbitrator is entitled to fix his fees as per the Schedule-IV of the Act. This Court further requests the learned Sole Arbitrator to endeavour to decide the dispute as expeditiously as possible. 7. Accordingly, this Arbitration Original Petition is ordered.
