Lr. No.9016/ I1/ 2025 passed by the 1st respondent and quash the same and consequently direct the respondent authorities 1 and 2 not to initiate any step contrary to the proceedings of the income tax authorities relating to the accounts of the petitioner organization. Counsel for R1 & R2 Order This Writ Petition is filed challenging the impugned proceedings dated 10.02.2026 whereby the appeals filed by the petitioner Society against the order of the second respondent, were rejected by the first respondent. 2. Learned counsel for the petitioner would submit that first respondent had submitted before this Court on 12.02.2026 (i.e.) two days after the impugned order came to be passed that the Appeals themselves were not maintainable before the first respondent. However, anti-dated impugned order has been passed by the first respondent. 3. Learned Government Counsel for the respondents 1 and 2 would submit that it is only a case of remand simpliciter with a direction to conduct enquiry after affording an opportunity of hearing to the petitioner and any other https://www.mhc.tn.gov.in/judis WP No. 26331 of 2026 __________ Page3 of 6 interested parties. He would further submit that the petitioner has no reason to feel aggrieved. 4. However, after submitting for a brief while, learned counsel for petitioner would submit that since the first respondent is superior in hierarchy to the second respondent, before whom the matter has been remanded, the second respondent may be influenced by the observations / findings made in the impugned order. 5. Allaying his fear, learned Government Counsel for the respondents 1 and 2 would submit that second respondent would proceed to conduct enquiry independently, without being influenced by the observations made in the impugned order. 6. Hence, it is open to the petitioner to put forth his submissions before the second respondent. Second respondent is directed to afford an opportunity of hearing to the petitioner, respondents 3 to 5 and other interested parties and pass appropriate orders in accordance with law. 7. It is submitted that the petitioner had been called for enquiry today. Accordingly, this Writ Petition is disposed of. No costs.
